Workers’ Compensation Insurance

In the U.S., employers are legally liable for medical bills and lost wages of employees injured on the job – regardless of fault. Workers’ Compensation insurance covers this obligation on behalf of the employer. With very few exceptions, Workers’ Compensation insurance is required in Maine for any business that has any employees.

Because Workers’ Compensation insurance is both mandatory and costly, agents at Noyes, Hall & Allen will work with you to properly classify your employees, and counsel you on simple documentation for independent contractors. This can reduce the cost of this important coverage, and avoid unexpected bills at audit time.

Individual business owners and partners may elect to purchase Workers’ Compensation coverage on themselves. Individual proprietors and partners are not automatically covered by Workers’ Compensation coverage in Maine. They must file an election form with the insurance company to be covered. A parent, spouse or child of an individual proprietor or partner may elect to be excluded. Once again, a form must be filed to do this.

Corporate officers are automatically covered under the corporation’s Workers’ Compensation insurance, but may elect to be excluded. A corporate officer must own more than 20% of the corporation and submit a waiver form to the Bureau of Labor in order to exclude themselves from Workers’ Comp coverage.
